CROSS-EXAMINATION OF THE COMPLAINANT During the man’s cross-examination, he confirmed to Elliott he went to school with the Sarnia police detective who was involved in this case. Elliott also pointed out to the man he was only on Miller’s team for a couple of months due to a teacher he had at the time. The man responded the teacher didn’t like him and he wasn’t a model child. Elliott pointed out his client was found not guilty of similar charges about two decades ago.
The lawyer noted the man only ran the clock at practices and questioned why he would need massages if he wasn’t sore from practising. The man replied he played other sports such as hockey and soccer. Elliott also questioned the timeline of the Detroit sports games he went to and showed him photos of him and his teammates at the various stadiums there. The man also confirmed to Elliott he flew to Penticton to visit Miller, who purchased his flight, when he was an adult.
The man also confirmed when asked by Elliott if he received legal advice through a lawyer Miller knew and asked Miller if he could use him as a reference on his resume. “Jim can talk,” the man said, adding he can sell anything.
